行人須知第一二課

你試過被人捉唔睇交通燈過馬路未? 幾年前我返工就被人捉過一次...

"小姐, 我企喺度你都過?!" 非常沮喪地被迫拎張身份証佢抄... 後來收到封告票, 寫咗個appeal, 罰咗幾百蚊, 算好彩.

前幾日返工, 兩條馬路有近十個交通警喺度派傳單, 嘩乜咁誇. 第一次見. 大家收過未?
知唔知原來"在行人過路處上逗留長於橫過行人過路處所需的時間"都係違例? 即係如果正常要行十二秒但你行咗廿秒都可能係違例... (英文: Remaining on a crossing longer than is necessary to pass over the crossing)

法例上,這很合理呢,馬路不是給行人逗留的,行人過路處卻需要給予例外,所以有此法例。

怎樣計「所需時間」,法例沒說哦,應該是「合理人」所需的時間,例如殘疾人仕、公公婆婆需要長時間之類。

因為馬路是給車行,所以惡攪地行「太慢」是不行的。這是法。
(再出奇的法例也有...哈...)

CR: 哈,佢已經imply了「合理人(reasonable man)」啦

(懶)讀2年法律,感覺真係... 1. 警權好大;2. 有錢人好著數
試諗下,若非3權分立,呢條法例都可以比差人玩好多野

As much as I love HK, I can't understand how cars are allow the override pedestrians!!! They are a threat to us!!! I hate cars, they should give way to us. Do they know there are more people than cars in Hong Kong?!! This is ridiculous. There's no where else in the world that I have been to that cars can get away from not giving way to pedestrians! And what do they mean by 'reasonable'?! Everyone's pace is different - are you going to charge an elderly for walking too slow?!

"Reasonable" is a term of law. Yes, you are right. Everyone's pace is different. For an elderly, "reasonable" gives more flexibility to defense.

If someone fell down on the road & got injured in an accident. Can this law "在行人過路處上逗留長於橫過行人過路處所需的時間" apply to him?

Yes. Because the law implies "reasonable" already: He need longer time on the road. So, it is easy for him to claim insurance. (If not apply, he may get trouble in insurance issues).

Um...law protects us a lot! Others, in HK history, there is no such case charging an elderly who "walked too slow" :)
